B-BEE AFFIDAVITS

Not every business requires a full verification to remain BEE compliant. Under the B-BBEE Codes of Good Practice, certain entities can confirm their B-BBEE level with a sworn affidavit instead of a full verification process. This simplified route is designed for smaller businesses and new entrants to the market, helping them stay compliant while contributing to South Africa’s goals of employment equity and broad-based economic empowerment.

Our experienced B-BBEE advisory team works closely with businesses to ensure every affidavit is prepared correctly, aligns with the Codes of Good Practice, and meets the expectations of their specific Sector Charter. Whether you’re an established enterprise or just starting your journey, we’re here to make compliance straightforward, transparent, and empowering.

Getting Your B-BBEE Strategy Right from the Start

Newly formed businesses, or Start-Up Enterprises, are automatically classified as Exempt Micro Enterprises (EMEs) for their first year of operation, regardless of their projected turnover. This gives new companies the opportunity to establish themselves while maintaining BEE compliance from the outset.

During this first year, a Start-Up Enterprise may submit a sworn EME affidavit as proof of its B-BBEE status. However, if the business tenders for a contract or project valued at more than R10 million but less than R50 million, it must be measured against the QSE Scorecard for that specific transaction. This ensures the entity is assessed fairly in relation to the scale and value of the opportunity.

Through our specialised B-BBEE advisory services, BBBEE Wise helps new businesses navigate these requirements with confidence. From understanding how the Codes of Good Practice apply to your operations, to preparing accurate documentation for tenders or verification, we make sure your transformation journey starts on a strong and compliant foundation.

BBBEE AFFIDAVIT FAQs

Is BBBEE compulsory?

B-BBEE is not legally compulsory for every business, but it is essential for companies that want to stay competitive and access new opportunities. While smaller entities can meet compliance through a sworn affidavit, larger businesses are required to undergo full verification.

Even if your business isn’t obligated, being BEE compliant strengthens your position in tenders, partnerships, and supply chains and contributes to South Africa’s goals of employment equity and broad-based economic empowerment. At BBBEE Wise, we help you understand what applies to your business and make compliance simple, transparent, and meaningful.

What is the difference between a BBBEE certificate and a BBBEE affidavit?

A B-BBEE certificate is issued after a full verification by a SANAS-accredited agency and is usually required for larger businesses. A B-BBEE affidavit is a sworn declaration available to smaller companies (EMEs and qualifying QSEs) that meet certain turnover and ownership criteria. It’s a simpler, cost-effective way to confirm B-BBEE status and is valid for 12 months.
